Florida Statute 316: A Motorcyclist’s Rules of the Road

Hitting the open road in any motor vehicle involves following speed limits and other traffic regulations. Additionally, if you’re a motorcyclist, you should be aware of a few specific rules for bikers.

Attorney Shannon J. Sagan, a motorbike accident lawyer serving South Florida, explains a motorcyclist’s rules of the road in the Sunshine State.

Florida Statute 316.209: General Rules of the Road for Motorcycle Riders

In most cases, motor vehicles of any type, including cars, trucks, and motorcycles, must follow the same traffic regulations. This includes speed limits, right of way, signaling, and other laws. As a motorcyclist, you should ride defensively, which includes:

  • Always keeping full control of your bike
  • Observing a safe distance from other vehicles
  • Taking extra care in bad weather or challenging road conditions

As a biker, you must obey the same use of lane rules as other vehicles. According to Florida Statute 316.209, you are entitled to use an entire lane and cannot ride alongside a car. You can’t weave between lanes, even when traffic is slow.

Lane sharing for motorcyclists only is legal in Florida, which means that two (but not more) motorcyclists can ride abreast if they choose to do so.

Florida Statute 316.211: Florida Helmet Laws

Florida mandates helmets for all motorcycle riders under 21. Motorcyclists 21 and older may choose to forego wearing a helmet if they carry a medical insurance policy of at least $10,000.

Additionally, helmets are not mandatory for bikers older than 16 who ride a moped of up to two BHP (brake horsepower) with a speed capacity of up to 30 miles per hour.
Whether a motorcyclist’s rules of the road in Florida require you to wear a helmet or not, we strongly recommend that you use one, regardless. Wearing a DOT-approved helmet is the number one way to reduce the risk of traumatic brain injuries in case of an accident.

Unlike helmets, appropriate protective eyewear is mandatory for all Florida motorcyclists.

Motorcycle Insurance

The State of Florida doesn’t require riders to carry motorcycle insurance if they have an insurance policy that covers at least $10,000 of medical expenses.

However, carrying a specific motorcycle insurance policy may make the claim process quicker and easier in case of an accident. You may also need this type of coverage if you plan to cross the state borders on your bike.

Motorbike Equipment

As a rider, you have a duty to keep your motorcycle in proper condition. Make sure you have:

  • Working lights, including turn signals, headlights, and taillights
  • Properly installed mirrors and reflectors
  • A visible back license plate
  • Appropriate passenger accommodations, if applicable
