What a free consultation actually is

People picture a sales pitch. It is closer to a diagnosis. You tell us what happened. We ask questions, look at your documents and footage, and give you an assessment based on Florida law: whether someone else is legally responsible, what compensation may be available, and what deadlines apply to you. If we believe you have a case, we explain what working together looks like. If we believe you do not, we tell you that too, and you have lost nothing but half an hour.

Three things it is not: it is not a bill (unlike other types of lawyers such as criminal, family law, business lawyers, you pay nothing, whether or not you hire us), it is not a commitment (you are free to walk away or talk to other lawyers), and it is not on the record for the insurance companies (everything you tell us is confidential).

What we review during the consultation

• The crash itself: how it happened, where, and who was involved. Dash cam or surveillance footage gets special attention. Reviewing crash video is the core of our practice, and video often answers the fault question in seconds instead of months.
• Your injuries and treatment: what care you have received, what is scheduled, and whether you are inside Florida’s 14 day window for no-fault medical benefits under Fla. Stat. § 627.736.
• Insurance coverage on every side: the other driver’s liability coverage, your own policy including uninsured motorist (UM) coverage under Fla. Stat. § 627.727, and any commercial policy if a work vehicle, rideshare, or delivery driver was involved.
• Your deadlines: for most crashes on or after March 24, 2023, Florida Statute § 95.11(5)(a) gives you two years from the accident date to file a negligence lawsuit, and some claims (for example, against government entities) have additional notice requirements.
• What has already been said: any statements you gave police or insurers, and how to handle insurer contact from this point forward.

What to have ready (none of it is required)

You do not need a single document to start. But if you have any of the following, they make the first conversation more productive: the crash report or exchange-of-information slip, photos of the vehicles and scene, dash cam footage (bring the original file, uncut), your insurance policy or declarations page, medical records or discharge paperwork, and any letters or voicemails from insurance companies.

One thing to do before you talk to any insurer

Most people call their own insurance company from the accident scene by instinct. We advise against it. Speak with an attorney about your rights first. You do have an obligation under your policy to cooperate with your insurer, but that obligation does not require an immediate call, and nothing requires you to give a recorded statement, to their insurer or your own, without legal advice. What you say in those first conversations can follow your claim for years, especially now that Florida’s modified comparative negligence rule (Fla.
